Victorian conveyancing system overhauled

As a result of the recommendations made in a review of conveyancing, the Conveyancers Act 2006 was recently passed by the Victorian parliament.

It establishes a new system of regulation and licensing for non-lawyer conveyancers, along with a number of eligibility requirements and consumer protection mechanisms. To be eligible to obtain a licence, applicants must have the required qualifications and work experience.

Transitional provisions allow existing conveyancers who satisfy all of the eligibility requirements three months from commencement to apply for a licence. The transitional provisions also allow current conveyancers, who do not have the required qualifications but are otherwise eligible, three months from commencement to apply for a provisional licence.

Conveyancers may continue practising forĀ five years under a provisional licence, but the work they can do is limited.

The Act is expected to be in force by July 2008.
