Victoria Regulates Solarium Industry


The September 2007 edition of Licensing Line News reported on regulation of the solarium industry. Victoria has now regulated the state's solarium industry with the Radiation (Tanning Units Amendment) Interim Regulations 2007. The regulations, made under section 139 of the Radiation Act 2005, came into effect on 1 February 2008 and follow from calls for the industry to be more tightly regulated.

The new regulations require:

  • the display of mandatory health warnings
  • solarium operators will now need to be licensed, with third-party audits to ensure ongoing compliance
  • nobody under 16 can be permitted to use a sun-tanning unit
  • 16 and 17-year-olds can only use a sun-tanning unit with parental consent
  • supervision of all solaria
  • the introduction of mandatory skin type assessments.

Significant penalties exist for non-compliance under the Radiation Act 2005.

The Victorian Government consulted with industry and key stakeholders in developing the regulations.
